Scope
These Guidelines clarify how safety responsibilities are allocated under the Work Health and Safety Act 2011 (NSW) and related construction regulations. RateRight provides only a digital platform and escrow service. We are not an employer, labour-hire agency, or site controller.
1. Our Role
- Provide technology tools (job posting, contracts, messaging, payments)
- Facilitate matching between hirers and independent contractors
- Do not control worksites, methods, or outcomes
- Accept no direct liability for site safety incidents, to the extent permitted by law
2. Worker Responsibilities
- Hold a valid ABN and relevant trade licences
- Maintain public liability insurance (minimum $10m)
- Carry out work in compliance with WHS laws and industry standards
- Use personal protective equipment (PPE) and follow training requirements (e.g., White Card)
- Immediately report notifiable incidents to SafeWork NSW (serious injury, illness, dangerous occurrence)
3. Hirer Responsibilities
- Provide a safe and compliant worksite
- Confirm worker licences and insurance before engagement
- Ensure site hazards are identified and controlled (falls, electrical, excavation, plant/machinery)
- Cooperate with workers in maintaining WHS compliance
4. Safe Practices
PPE Requirements
Workers must wear PPE appropriate for their trade (e.g., helmets, harnesses, gloves).
High-Risk Construction Work
Must have a Safe Work Method Statement (SWMS).
Specific Compliance Standards
- Electrical work: comply with AS/NZS 3012 standards
- Confined spaces: comply with AS 2865
- Plant & equipment: only licensed operators may use heavy machinery
5. Incident Reporting
Worker Obligations
Notify hirer immediately of hazards or incidents.
Hirer Obligations
- Must report notifiable incidents to SafeWork NSW (13 10 50 or online) as required by law
- Keep records of incidents, near misses, and safety meetings
6. Platform Enforcement
- Users breaching safety obligations may face account suspension or removal
- RateRight may share information with regulators if required by law
- Repeated safety failures may lead to permanent removal from the Platform
